Questions and answers on freelance administration

Freelance administration

Is the freelance administration method legal?

Yes. Its utility was officially recognised by law dated 25/06/2008 on the Modernisation of the Employment Market, No. 2008-596. It is defined in article L.1251-64 of the new labour code.

What are the criteria for choosing a freelance administration company?

There are 5 main quality criteria to take into account when choosing a freelance administration company:

  • the age of the company,
  • the date on which your wage is paid,
  • service quality, clearness and rapidity of answers, advisors’ proficiency,
  • the management fee applied (be careful of extra costs),
  • ease of keeping track of your activity breakdown.

Can I take on an assignment if I get unemployment benefit?

Yes. You then have to declare this activity to the ASSEDIC. If it doesn't exceed 110 hours and 70% of your previous salary, you can receive complementary allowance for the month. If you exceed one of the two thresholds stated above, you will not receive any allowance for the month in question, but your rights will be carried over.

Can I take on an assignment if I’m retired?

For retired people who come under the general regime or the regime of agricultural employees, whose pension took effect after 2003, it is possible to take up a professional activity, as long as you do not exceed an income threshold. In addition, you have to wait six months from settlement of your retirement before being able to go back to work for your previous employer.

The CRAM and your complementary retirement fund will be able to help you define this threshold.

Do I have to wait for the customer to pay before getting paid myself?

If your customer is in France, no. Wage is calculated depending on what you invoice. If your customer is abroad, yes. Wage is established after the month’s payments have been received.

How do you reimburse expenses?

Based on original proofs and actual trips, within a reasonable limit in relation to turnover, i.e. around 10% of turnover.

Every month, you will receive a breakdown of your activity, including invoices made, your expenses and your salary.
